사회복지사란 사람들을 돕는 일을 하는데, 그 과정에서 윤리적인 가치를 잊지 않고 해야 해요.

 

하지만 가끔은 어떤 걸 더 중요하게 봐야 할지 고민이 생기기도 해요.

그런 상황이 와서 어떤 걸 우선순위에 둘지 얘기해 보려고 해요.

이런 상황을 상상해봐요.

아이들을 보호하는 일을 하는 사회복지사가 아이가 학대를 당했는지 조사하려는데,

아이의 부모님이 '우리가 아이를 학대하지 않았어요'라며 조사를 거부하는 상황이 벌어졌어요.

이런 상황에서 윤리적인 고민이 생길 수 있어요.

1. 아이의 안전을 위한 조사와 부모님이 주장하는 권리
2. 사건에 대한 정보를 공유하면서도 개인정보를 보호하는 문제
3. 의심되는 사례를 조사하면서도 부모님의 의견을 듣는 것

이런 상황에서 법과 윤리가 충돌하게 되면 어떤 걸 우선시 해야 할지 고민이 될 수 있어요.

 

이런 딜레마를 잘 해결하는 방법을 찾아내는 건 쉽지 않아요.

하지만 만약 저라면, 이런 상황에서 법과 윤리가 충돌할 때 윤리를 더 중요하게 생각하겠어요.

사회복지사는 사람들의 권리와 존엄성을 존중해야 하지만, 그보다 더 중요한 건 그 사람들이 안전하게 지낼 수 있도록 돕는 거예요.

아이들을 보호하는 사회복지사라면 아이의 생명과 안전이 가장 중요해야 하고, 이를 지키는 건 복지사로서의 기본적인 윤리에요.

그래서 만약 아이가 학대를 당했다는 의심 사례에서 아이의 안전이 위협된다면,

이를 조사하고 바로 대응하는 게 가장 중요하다고 생각해요.

물론 부모님의 권리도 중요하고, 개인 정보 보호도 중요하니까,

부모님과 충분히 얘기하면서 아이의 안전을 지킬 수 있는 방법을 함께 찾아봐야 해요.

윤리를 우선순위로 두면, 사회복지사가 자신의 일을 잘하면서 법을 지킬 수 있어요.

그렇게 되면 굳이 윤리를 포기하지 않아도 되겠죠.

 

결국, 사회복지사로서 윤리적인 행동을 우선하고 책임감 있게 일하는 것이 가장 중요하다고 생각해요.

그래야 사회복지사의 역할을 제대로 수행하면서, 법과 윤리를 잘 조화시킬 수 있겠죠.

1. investigating for the safety of the child and the rights of the parents to do so
2. how to protect privacy while sharing information about the incident
3. listening to the parents while investigating the suspected case.

When law and ethics collide in these situations, it can be hard to know which to prioritize.

It's not easy to figure out how to navigate these dilemmas.

However, if it were me, I would prioritize ethics over law in this situation.

As a social worker, you have to respect people's rights and dignity, but more importantly, you have to help them stay safe.

If you're a social worker protecting children, the life and safety of the child should be the most important thing, and it's a basic part of your ethics as a social worker.

So if you have a suspicion that a child has been abused and their safety is threatened,

I think it's very important to investigate and respond immediately.

Of course, parental rights are important, privacy is important,

you have to talk to the parents and figure out how to keep the child safe.

By prioritizing ethics, social workers can do their job well and still follow the law.

Then you don't have to sacrifice your ethics.

In the end, I think it's most important to prioritize ethical behavior and work responsibly as a social worker.

That way, you'll be able to do your job as a social worker and still be able to balance the law and ethics.
